These Terms govern your use of nicheperks.com (the "Site"), operated by PIPS & TCKS LLC ("NichePerks"). By using the Site you agree to these Terms. If you do not agree, do not use the Site.

1. What NichePerks is

NichePerks is a discovery platform for verified offers, cashback, and emerging direct-to-consumer (D2C) brands. We do not sell products. When you click an outbound link, you transact directly with the brand under that brand's terms.

2. Offers, codes, and verification

We work to keep offers accurate and current, but coupon codes, cashback rates, and brand availability can change without notice. We label each offer with a verification status and last-checked date. Use that information when deciding whether to redeem an offer. Codes may fail due to merchant changes, geographic restrictions, cart conditions, or expiration. NichePerks is not responsible for an offer that does not apply at checkout.

3. Affiliate relationships

Many outbound links on the Site are affiliate links. When you make a purchase after clicking one, we may earn a commission. This does not change the price you pay. See our Affiliate Disclosure.

4. Cashback (beta)

Cashback features on NichePerks are currently in beta. Cashback is earned only when (a) your purchase is tracked through our affiliate link, (b) the merchant confirms the sale to the affiliate network, and (c) the transaction is not later returned, canceled, or reversed. Pending balances are not cash and do not constitute a deposit. Payouts, when issued, may be in the form of a gift card or other instrument and are subject to a minimum threshold of $25. Full cashback terms will be published with the cashback launch.

5. Acceptable use

You agree not to: (a) attempt to disrupt, attack, or reverse engineer the Site; (b) scrape, copy, or republish substantial portions of the Site without our consent; (c) submit false coupon reports, fake brand submissions, or content that infringes any third party's rights.

6. User submissions

If you submit a coupon report, brand suggestion, or other content, you grant NichePerks a non-exclusive, royalty-free, worldwide license to use, display, and adapt that content to operate and improve the Site. You represent you have the right to submit it.

7. Intellectual property

The Site (including its design, original content, and database of curated brand records) is owned by NichePerks and protected by intellectual property laws. Brand names, logos, and trademarks shown on the Site are the property of their respective owners and are used for identification and editorial purposes only.

8. Disclaimers

The Site is provided "as is" and "as available." To the maximum extent permitted by law, NichePerks disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any offer will be available, accurate, or applicable to your purchase.

9. Limitation of liability

To the maximum extent permitted by law, NichePerks will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Site. NichePerks's total liability for any claim relating to the Site shall not exceed $100.

10. Indemnification

You agree to indemnify and hold NichePerks harmless from any claim arising out of your misuse of the Site or breach of these Terms.

11. Governing law

These Terms are governed by the laws of Texas, USA, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the courts located in Dallas County, Texas.

12. Changes

We may update these Terms from time to time. Material changes will be posted on this page with a revised "Last updated" date.
